Terms and Conditions of Sale and Use of
www.warehouse14.co.uk dated 1st March 2014 (the “Terms”)

Please read these Terms carefully.


Any use of the
www.warehouse14.co.uk web site by any person, firm or company (“Visitor”) or any business transacted with Warehouse14 by any person, firm or company (“Purchaser”) is subject to these Terms.
Warehouse14, by accepting any order for products or services (“Product(s)”) from the Purchaser, agrees to sell and the Purchaser agrees to purchase Product(s) at the
price stated on the Warehouse14 web site and on the sole basis of these Terms.

Price
  • The price for the Product(s) is shown on www.warehouse14.co.uk web site as is the appropriate rate of VAT.  VAT rates and amounts may vary depending on the type of Product(s)and current legislation.
  • Warehouse14 endeavours to make sure all prices are accurate. If an error in pricing of the Product(s) is discovered after taking an order for it/them, Warehouse14 will inform the Purchaser as soon as possible using the contact details supplied. The Purchaser will have the option to reconfirm the order at the correct price or cancel it. In the event that the Purchaser cannot be contacted after a reasonable period, the order will be treated as cancelled and the Purchaser informed in writing of the cancellation. If an order is cancelled, any payment made for the Product(s) will be refunded in full.
  • The Purchaser will be notified of the delivery costs before submitting payment details. Delivery costs can be found on www.warehouse14.co.uk.
  • Prices are quoted in UK pounds and the Purchaser must make payment in UK pounds. Any refunds will be made in UK pounds.

Payment
  • Payment by the Purchaser must be made once the required Product(s) have been selected and the delivery charge displayed together with any other extras selected (extras could include special wrapping, for example).
  • Payment can be made online via PayPal, either by using the Purchaser’s own PayPal account or by using the debit and credit card facilities provided by PayPal.
  • Payment can also be made by cheque or bank transfer when orders are placed by telephone or fax.
  • Payments can be made by credit or debit card (for example VISA, MasterCard, Solo & Maestro) using the PayPal facility.
  • The Purchasers credit or debit card company may carry out security checks to confirm the validity of the purchase.
  • All transaction documentation and invoices will be sent to the payment card billing address and not the delivery address if this is different.
  • If the Purchaser wishes to pay by cheque or bank transfer the Product(s) cannot be despatched until Warehouse14 has cleared funds. Cheques should be made payable to Warehouse14 Ltd for the total value of the Product(s), delivery charges and any other extras selected including VAT.  Bank Transfers can be made to:  TBA

Availability
  • Warehouse14 will endeavour to keep www.Warehouse14.co.uk as up to date as possible but cannot guarantee that particular Product(s) will always be available.
  • Warehouse14 may withdraw Product(s) at any time without notice.
  • If Warehouse14 cannot supply the Product(s) ordered, the Purchaser will not be charged and a full refund or credit will be arranged promptly.
  • All special offers are only available while stocks last.
  • In the event that the Product(s) ordered not being available, a representative from Warehouse14 will contact the Purchaser using the contact details provided.

Delivery
  • Warehouse14 delivers to UK destinations.
  • The Purchaser will be required to provide a detailed and accurate delivery address especially if the delivery is to a hospital or hotel when it is the Purchasers responsibility to make suitable arrangements at the facility to ensure the recipient is aware and available to receive the delivery.
  • The Purchaser will be notified of the delivery costs before submitting payment details.
  • If a Purchaser pays by cheque or bank transfer or orders Product(s) by telephone, the Purchaser will be advised of the delivery costs.
  • Product(s) that are held in stock and marked “Available” on www.Warehouse14.co.uk will be despatched within 5 working days of an order being placed. However, during busy times, such as leading up to Christmas, despatch may be longer. The Purchaser will be advised by telephone or email if the Product(s) are not in stock.  Warehouse14 does not guarantee delivery times.
  • Warehouse14 offers standard and next day delivery options.
  • Orders are despatched either by Royal Mail or Courier.  Couriers require a signature on delivery of the Product(s) and usually operate during normal working hours on working days only. The Purchaser is responsible for specifying a delivery address where someone will be able to sign for the Product(s) during these hours. In the event that no one is available to sign for the delivery the courier will leave a card with instructions for rearranging delivery or collection. If the courier eventually returns the order to Warehouse14 a full refund excluding the delivery charges (which will include the charge to return the order to Warehouse14), will be arranged. If the courier returns the order to Warehouse14 as a result of an error by the Purchaser then the Purchaser will be charged for redelivery.
  • Warehouse14 will make every effort to deliver promptly but is not liable for any loss caused whatsoever by late delivery.
  • The Purchaser should contact Warehouse14 by telephone or email if the Product(s) are not delivered within the delivery time quoted. Warehouse14 will investigate and keep the Purchaser informed as appropriate.
  • The Purchaser should order from Warehouse14 with adequate lead-time.
  • Warehouse14 will arrange for full refund if the ordered Product(s) fail to be delivered.
  • This does not affect the statutory rights as a consumer.

Force Majeure
  • Warehouse14 will exercise every reasonable effort to deliver quickly but shall not be liable for any loss or damage due to delays or failure to ship resulting from any cause beyond its reasonable control, such as but not limited to, compliance with laws or regulations, acts of God, acts or omissions of the Purchaser, acts of civil or military authority, judicial action, defaults of suppliers, labour disputes, failure or delays in transportation, embargoes, wars or riots.

Copyright and Trade Marks
  • A Purchaser acquires no rights or interest in any copyright or intellectual property in any Product(s) available from Warehouse14 or the right to copy them.
  • The copyright in www.Warehouse14.co.uk and the content of all the software, web site and pages relating to the www.Warehouse14.co.uk web site is owned by, or licensed to Warehouse14, unless otherwise specified and may not be used, copied or altered without written consent from Warehouse14. Copyright extends to the design, look and feel of www.warehouse14.co.uk, all images on it and its marketing materials.
  • Visitors to the web site may browse, view, copy or print sections for the sole purpose or intent to place orders. The content of www.warehouse14.co.uk may not be used for any other purpose.
  • The names Warehouse14, www.warehouse14.co.uk and logos are the property of Warehouse14 and may not be used by anyone else without written permission from Warehouse14.
  • Warehouse14 does not make any warranty or representation in respect of trademarks of the brands featured on www.Warehouse14.co.uk, which belong to their respective owners.

Privacy and Data Policy
  • Warehouse14 is committed to protecting privacy and promises only to use information collected about a Purchaser lawfully and in accordance with the Data Protection Act 1998.
  • Warehouse14 collects information about Purchasers for three reasons:
             1. To process an order;
             2. To provide the best possible service;
             3. To help prevent fraud.
  • When a Purchaser places an order, Warehouse14 will collect certain information and personal data (for example name, telephone number, postal address, email address). Warehouse14 may also record which Product(s) web site Visitors are interested in and which Product(s) Purchasers buy as well as Visitor traffic patterns and site use. This information will be kept securely.
  • By placing an order and submitting data a Purchaser agrees to the use of the information and personal data submitted.
  • Warehouse14 may, from time to time, monitor and record telephone calls for training purposes and to improve the service provided.
  • Warehouse14 will never collect sensitive information about a Purchaser or web site Visitor without explicit consent.
  • Warehouse14 has voluntarily registered with the Information Commissioner as a Data Controller with respect to the Data Protection Act 1998.
  • Warehouse14 regularly reviews its Privacy and Data Policy and may change the Policy from time to time. The revised Policy will be displayed on www.warehouse14.co.uk.
  • Purchasers and Visitors to www.warehouse14.co.uk can contact Warehouse14 about the Privacy and Data Policy using the contact details displayed or email sales@Warehouse14.co.uk.
  • As a Purchaser, Warehouse14 may offer you the option, when placing an order, to receive marketing information from Warehouse14. A Purchaser can elect not to receive marketing information at the point of placing an order or at any time thereafter by sending an email to sales@Warehouse14.co.uk.
  • Warehouse14 will not sell, trade or rent your personal information to other companies, businesses, organisations or persons.

Cookies
  • In order to improve its service and web site, Warehouse14 may use a 'cookie' (a means of tracking web site Visitors Internet activity i.e. whether the Visitor has visited www.warehouse14.co.uk before) and is recorded on the Visitor’s hard disk. Warehouse14 may use these cookies to improve www.warehouse14.co.uk and the Product(s) and services available to a Purchaser. 
  • A Visitor can adjust its internet browser settings to stop Warehouse14 using cookies.

Customer Service - Complaints
  • With the exception of returns and refunds web site Visitors and Purchasers should use the contact forms displayed on the web site to register a complaint.

Customer Service - Returns & Refunds Policy and Terms
  • Warehouse14’s returns and refund policy and terms, which do not affect a Purchaser’s statutory rights, are as follows:
         Unwanted Product(s)
  • If a Purchaser is not happy with the Product(s) when delivered or the Purchaser has a change of mind, Warehouse14 will refund the purchase price excluding any delivery costs or extras less 20% for restocking. The Purchaser is entitled to cancel the order up to 7 days after the day following delivery.
  • Warehouse14 will make any refund due for unwanted product(s), within 15 days of the notification to Warehouse14.
  • Any unwanted items must be returned to Warehouse14's address (as displayed on our website). The Product(s) must be returned within 7 working days after day of delivery, with the despatch note, in an unused condition, having taken reasonable care with packaging and all components or accessories.
         Faulty or Incorrectly Supplied Product(s)
  • If the Product(s) arrives damaged or with defects, or not as ordered, Warehouse14 will replace the Product(s) free of further charge or provide a full refund including delivery costs and any extras if the Purchaser wishes as long as Warehouse14 is notified of the damage or defect within 3 days of delivery.
  • Warehouse14 will make the refund referred to above, within 10 days of the Product(s) arriving at Warehouse14’s address (as displayed on our website) complete and in good order.
  • Refunds for faulty or incorrectly supplied Product(s) will include the return postage if the Purchaser provides an appropriate receipt for the cost of return postage within 10 days of the Product(s) being returned.
  • If the Purchaser chooses to receive a replacement, this will be despatched at Warehouse14’s cost on receipt of the faulty or incorrectly supplied Product(s) with the despatch note, in an unused condition, having taken reasonable care with packaging and all components or accessories at Warehouse14’s address, as displayed on our website.
         Returning Unwanted, Faulty or Incorrectly Supplied Product(s)
  • The Purchaser must advise Warehouse14 of the return by telephone (on 01986 891488) or by email (sales@Warehouse14.co.uk).
  • Warehouse14 may provide specific return instructions.
  • The Purchaser will be responsible for the returning Product(s) until they reach Warehouse14 at the address displayed on our website.
  • Products should be returned in the condition they were received with all packaging and labels.

Cheque and Bank Transfer Payments
  • If a refund becomes due in the instances described above and the original payment was made by cheque or bank transfer, Warehouse14 will make the refund by cheque to the Purchaser.

Security Matters
  • Visitors and Purchasers must not use any facilities provided by Warehouse14 for any illegal purpose or for accessing, receiving or transmitting any material deemed illegal, indecent, offensive or otherwise unacceptable under UK law.
  • Any passwords or usernames provided by Warehouse14 must be kept secret and not disclosed to anyone.
  • Visitors and Purchasers must not attempt or participate in the unauthorised entry or viewing of another Purchasers details or into another system.

General Terms and Responsibilities
  • Warehouse14 will try to ensure the descriptions (including images) of the Product(s) are accurate. Images are for guidance only.
  • All dimensions quoted are approximate.  Where dimensions are quoted for boxes they refer to the internal dimensions of the erected box.
  • Warehouse14 will insure the Product(s) in transit at the retail value. The Purchaser must check the condition of the delivered Product(s) as soon as possible after receipt and report any damage to Warehouse14 immediately and mark the courier’s delivery documentation if the packaged Product(s) appears to be damaged.
  • Warehouse14 will endeavour to provide an impeccable service, applying good skill and care. However, Warehouse14 does not give any guarantees, warranties or representations in respect of any other parties’ services associated with Warehouse14’s business.
  • Warehouse14 maintains www.warehouse14.co.uk to the best of its ability but cannot guarantee an uninterrupted service or that it is entirely error free.
  • www.Warehouse14.co.uk contains links to other websites. Warehouse14 is not responsible for the control or content of any web site not maintained by Warehouse14. These links are provided for convenience only.
  • Warehouse14 cannot guarantee the security of email communication. Using the Warehouse14 email facility is at the users own risk.
  • Except as provided in these Terms, Warehouse14 provides no other warranties, conditions or other terms, express or implied, statutory or otherwise and all such terms are hereby excluded to the maximum extent permitted by law.
  • Warehouse14 is not liable in any way for failure to perform any obligation under these Terms if such failure is caused by the occurrence of any unforeseen event beyond its reasonable control including and without limitation to Internet outages, communications outages, fire, flood, war or act of God.
  • Subject as aforesaid, to the maximum extent permitted by law, Warehouse14 excludes liability for any loss or damage of any kind howsoever arising, including without limitation any direct, indirect or consequential loss whether or not such arises out of any problem the Purchaser notifies to Warehouse14, and Warehouse14 shall have no liability to pay any money by way of compensation, including and without limitation to all liability in relation to:
  1. any incorrect or inaccurate information on www.warehouse14.co.uk;
  2. the infringement by any person of any Intellectual Property Rights of any third party caused by the use of www.Warehouse14.co.uk or any Product(s) purchased through Warehouse14;
  3. any interruptions to or delays in updating www.warehouse14.co.uk;
  4. any loss of profit, wasted expenditure, corruption or destruction of data or any other loss;
  5. any loss or damage resulting from the use or the inability to use the www.warehouse14.co.uk web site or resulting from unauthorised access to, or alteration of transmissions or data in circumstances which are beyond Warehouse14’s control;
  6. any amount or kind of loss or damage due to viruses or other malicious software that may infect a Visitors or Purchasers computer equipment, software, data or other property caused by persons accessing, using or downloading www.warehouse14.co.uk, or from transmissions via emails or attachments received from Warehouse14 or its licensees and affiliates;
  7. all representations, warranties, conditions and other terms which but for this notice would have effect.
  8. the availability, quality, content or nature of other sites on the Internet that are not owned by Warehouse14 to which www.Warehouse14.co.uk links to (“Linked Sites”) and web sites located on or through any Linked Sites nor for any transactions involving Linked Sites (including 'cookies', personal data, confidential information, or purchases of domain names or other services);
  • Warehouse14 may change or withdraw any part of www.smartkartoneu.co.uk, or may refuse access at any time.
  • Warehouse14 may terminate, immediately remove, cancel or suspend access to and use of www.warehouse14.co.uk upon breach of any part of these Terms whatsoever. Termination shall be without prejudice to Warehouse14's other rights.
  • Warehouse14 acts as principal on its own account and not as agent for any other person.
  • Warehouse14 may choose to waive any provision of this agreement and such action will not be considered a continuing waiver.
  • In the event that any part of these Terms is held to be unenforceable, that part will at Warehouse14's option be construed as far as possible to reflect the parties' intentions and the remainder of the provisions will remain in full force and effect.
  • These Terms constitute the full agreement between a Visitor or Purchaser and Warehouse14 to the exclusion of all other terms or conditions of contract proposed. These Terms may only be amended in writing.
  • The Purchaser is responsible for any breach of these Terms by the Purchaser and will be liable for any loss or damage suffered by Warehouse14 as a result.
  • These Terms shall not limit any rights a Purchaser may have as a consumer that may not be excluded under applicable law nor shall they exclude or limit Warehouse14's liability for death or personal injury resulting from its negligence or any fraudulent representation.
  • It is the Purchasers responsibility to read instructions, manuals and other documentation supplied with the Product(s) carefully. Warehouse14 is not involved in the manufacture of the Product(s) and will not advise on their use or operation or the manufacturer's guidelines. Purchasers are advised to use all Product(s) safely and in accordance with the manufacturer's guidelines.
  • These Terms do not affect the statutory rights as a consumer.
  • www.warehouse14.co.uk is directed to UK Visitors and consequently Smart Karton cannot guarantee the web site complies with laws and regulations of any other countries or territories.
  • These terms are subject to the laws of England and the jurisdiction of the English Courts.
